What is a misdemeanor?

Misdemeanors are lesser crimes that are punishable by a fine and/or time in county jail for up to one year.  Misdemeanor offenses are tried at the lowest level of local court.  Some common criminal offenses typically considered to be misdemeanors are petty theft, driving under the influence (DUI) as long as no one is injured, disturbing the peace, simple assault, public intoxication, and traffic violations.  Sometimes a crime may be considered a misdemeanor while other times it may be considered a felony, so you will need to speak with an Atlanta criminal defense lawyer about the difference.

What is a felony?

Felonies are serious crimes which are punishable by time in a state prison or death.  Individuals charged with felony offenses will typically spend at least one year in a state prison.  Certain felonies may be considered federal offenses and will be tried at Federal Court.  Murder, rape, robbery, manslaughter, kidnapping, and arson are all considered to be felonies.      

If there is evidence against me, do I still have a chance at overcoming my charges?

Yes.
